Immigration Evaluations for VAWA, U-Visa, and Asylum Cases

Psychological evaluations play a specific clinical role in certain immigration cases involving violence, trafficking, and asylum-seeking. This article provides general educational information about evaluations for VAWA, U Visa, T Visa, and asylum-related proceedings.

VAWA Cases

The Violence Against Women Act (VAWA) allows certain individuals who have experienced abuse by a U.S. citizen or lawful permanent resident spouse, parent, or child to self-petition for immigration relief. Psychological evaluations in VAWA cases may document the emotional and psychological impact of abuse, trauma symptoms, and related clinical findings.

U Visa Cases

The U Visa is available to individuals who have been victims of certain qualifying crimes and who have suffered substantial physical or mental abuse as a result. A psychological evaluation in a U Visa case may document the nature and extent of that abuse and its psychological impact.

The evaluation is conducted by a licensed clinician who prepares a written report based on a clinical interview and, when appropriate, standardized assessment tools. The report is submitted as part of the application — it does not determine the outcome.

T Visa Cases

The T Visa is available to survivors of trafficking. Psychological evaluations for T Visa cases may document the psychological effects of trafficking experiences, including trauma symptoms, fear, and related mental health presentations.

Asylum Cases

In asylum-related proceedings, psychological evaluations may be used to document the psychological impact of persecution, torture, or other qualifying experiences. Clinical documentation of post-traumatic symptoms, fear of return, and related mental health findings may be submitted as part of the asylum case file.

Asylum determinations are made by immigration judges and adjudicators. The evaluation supports — but does not determine — the legal outcome.
